Thanks so much for the update, Cathy. Hate to hear of anyone losing their home, but this has been a bad situation getting continually worse for many years. No workable resolution for current owners/occupants.

Hi Suzie & Neighbors,
Good timing as I heard back from the city attorney this afternoon. For some context, HUD is a leinholder on the house. Here’s the city attorney’s update:

I have attached a copy of the order issued by the judge. It requires the property to be vacated in 10 days and repaired in 60 days. After the deadline to vacate expires the structure will need to be secured. After that, the only individuals allowed on the property are workers making repairs under a permit issued by the city. If individuals violate the order to vacate, we can issue citations and seek escalated enforcement if necessary. If they fail to make repairs by the deadline, the city will move forward with demolition. HUD could bring a foreclosure action at any time or take other action depending on their rights under the loan documents. If the property is listed for sale but repairs are not made, the city will still move forward with demolition.

So if anyone sees anyone on the property, report it to the city immediately. And if anyone is on the property between 7pm and 7am, report that as well.
And by 3/15 if the house isn’t completely fixed, we should see it getting demolished soon thereafter.
Thanks!

 Hi Neighbors,
Many people have expressed concern about the house at 10728 Brookport Place. There is activity going on that I thought many people would be interested in.

   - A court hearing is scheduled for this coming Monday 1/12 at 9am at the Dallas City Municipal Court (2014 Main St, Dallas, TX 75201), courtroom 11 on the 4th floor. It is a docket hearing so the case specifically concerning this house is somewhere within the docket of various other cases. The docket hearing will probably end by 11am. The hearing is open to the public so feel free to attend in person if you’re interested.
   - The city attorney is asking for the house to be vacated and demolished. It seems like he feels pretty confident the judge will approve the vacancy request but is unsure about the demolition. If the vacancy request is approved, the occupants will have a certain amount of time to vacate (probably 30 days). After which the city would board up the property to prevent re-entry.
The city attorney is being kind enough to relay to me what the outcome is on Monday’s hearing. So when I hear from him next week, I’ll share that update here (unless any of you go to the hearing in person and want to share with us first!)
Hope that’s helpful - and fingers crossed for a good outcome come Monday!
Sincerely,
Cathy Brightman
